• Communication with the UK Intellectual Property Office (UKIPO)

Important: Our services are limited to the initial trademark application process. We do not provide legal representation for opposition proceedings, appeals, or any disputes that may arise after the application is filed.

3. Eligibility

By using our services, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You are not prohibited from using our services under applicable law
• The information you provide is accurate, complete, and current
• You have the right to register the trademark you are applying for

4. Account Registration

To use certain features of our services, you may need to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if we suspect any unauthorized or fraudulent activity.

5. Fees and Payment

5.1 Pricing

Our fees are as set out on our Pricing page and may be updated from time to time. All fees are quoted in British Pounds (GBP) and are exclusive of VAT unless otherwise stated.

5.2 Payment Terms

Payment is required in full before we begin processing your trademark application. We accept various payment methods as indicated on our website.

5.3 Refund Policy

Refunds may be available under certain circumstances:

• If we have not yet submitted your application to the UKIPO, you may request a full refund minus an administrative fee
• Once the application has been filed with the UKIPO, no refunds will be issued as government fees are non-refundable
• Refunds will be processed within 14 business days of approval

6. Intellectual Property

6.1 Your Content

You retain all rights to any content you submit to us, including trademark information and business details. By submitting content, you grant us a limited license to use such content solely for the purpose of providing our services.

6.2 Our Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of Register a Trademark UK or our licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

7. Prohibited Activities

You agree not to:

• Use our services for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt our services
• Submit false or misleading information
• Infringe upon the intellectual property rights of others
• Use our services to apply for trademarks you do not have the right to register

8. Limitation of Liability

8.1 No Guarantee of Registration

We do not guarantee that your trademark application will be successful. The UKIPO makes the final decision on all trademark registrations, and we cannot control or influence their decision.

8.2 Limitation of Damages

To the maximum extent permitted by law, Register a Trademark UK shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or relating to your use of our services.

8.3 Maximum Liability

Our total liability to you for any claims arising from or relating to these Terms or our services shall not exceed the total amount you paid us for the specific service giving rise to the claim.

9. Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. We do not warrant that:

• Our services will be uninterrupted, timely, secure, or error-free
• The results obtained from using our services will be accurate or reliable
• Any errors in our services will be corrected

10. Indemnification

You agree to indemnify, defend, and hold harmless Register a Trademark UK and our officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of our services
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit to us

11. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use our services will cease immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
